CresPerks Terms & Conditions

Introduction

These terms and conditions constitute a legally binding contract between Techwave Pty Ltd (ABN 13 644 894 397) (Techwave) and you in relation to Techwave's membership reward program CresPerks. By signing up to be a member of CresPerks you confirm that you have read, understood, and agree to these terms and conditions.

Acknowledgement

By signing up to be a member of CresPerks you agree:

1. that you have, or will create, and maintain, a Techwave account, including maintaining a verified email address and mobile phone number;
2. to subscribe to communications from Techwave in relation to CresPerks through methods such as email, SMS and social media platforms;
3. to subscribe to marketing communications from Techwave to promote and market products, services or special offers to you in relation to Techwave through methods such as email, SMS and social media platforms;
4. to Techwave contacting you for reviews and your feedback in relation to CresPerks; and
5. to these terms and conditions, which may be updated or amended by Techwave from time to time.

Overview

CresPerks is a membership reward program where you may receive exclusive member benefits such as:

• a $10 Techwave coupon when you join CresPerks;
• extra member discounts from time to time;
• early notification of certain Techwave sales; and/or
• a birthday perk.

Techwave may vary the features, offers and/or benefits of CresPerks in its absolute discretion at any time. Any coupon provided to you is available for a limited time and is provided for the purposes of CresPerks, which is a customer loyalty program. Note that if you join CresPerks in the month of your birthday, you will not be eligible to receive a birthday perk until the following calendar year.

Termination of CresPerks

Techwave may terminate CresPerks and/or your CresPerks membership in its absolute discretion at any time. Techwave will automatically terminate your CresPerks membership if you do any of the following:

• delete your email address and/or phone number from your Techwave account;
• delete your Techwave account; or
• unsubscribe from CresPerks communications.

You can end your CresPerks membership at any time, by clicking on the unsubscribe link in an email from us, by submitting an enquiry to [email protected], or by texting the stated response word (e.g., STOP" or UNSUBSCRIBE) in reply to an SMS from us. Any benefit, offer or coupon that you receive as part of your CresPerks membership may be redeemed by you up to the date on which the benefit, offer or coupon is expressed to expire, even if we vary or terminate CresPerks or if you end your CresPerks membership.

CresPerks Communications

In order to be a member of CresPerks, you must continue to be subscribed to communications in relation to CresPerks. If you unsubscribe from communications in relation CresPerks, your CresPerks membership will automatically end. You can unsubscribe from communications from CresPerks at any time by clicking on the unsubscribe link in an email from us, by submitting an enquiry to [email protected] , or by texting the stated response word (e.g., STOP" or UNSUBSCRIBE) in reply to an SMS from us. Note that ending your CresPerks membership will not unsubscribe you from Techwave marketing communications. To unsubscribe from Techwave marketing communications, you will need to follow the unsubscribe process set out in section 6 below.

Privacy and Marketing

By signing up to CresPerks you consent to subscribe to Techwave marketing communications and to the collection, use and disclosure of your personal information as set out in the Techwave's Privacy Policy (as updated from time to time). You can unsubscribe from marketing communications from Techwave at any time by following the unsubscribe instructions in the relevant communication e.g. texting STOP in reply to an SMS from us or by clicking on the unsubscribe link in an email from us. You can also unsubscribe from marketing communications by submitting a privacy enquiry. Note that unsubscribing from Techwave marketing communications will not end your CresPerks membership. To end your CresPerks membership, you will need to follow the process set out in section 4 above.

Your Responsibilities

You acknowledge and agree:

• that only one account may be created per person. If you create more than one account we may terminate any additional accounts created by you without notice, and any offers, benefits or coupons issued to such account(s) may not be redeemed; and
• to protect and keep confidential your account password and any other information required for a person to access your Techwave account and CresPerks membership.

General Disclaimer

Except to the extent required by law, Techwave:

1. makes no representations or warranties of any kind as to the operation, availability, or form of CresPerks offers or discounts, or the information, content or materials included within CresPerks, and all implied representations or warranties in relation to the operation or availability of CresPerks or the information, content or materials contained within CresPerks are excluded; and
2. is not responsible for any loss suffered by you in connection with CresPerks, including any indirect, consequential, or special damages and any loss of revenue, loss of profits, loss of goodwill, loss of business opportunity, loss of reputation business interruption or loss of data or information.

Changes to Terms & Conditions

To the extent permitted by law, Techwave may change these terms and conditions from time to time on reasonable prior notice. Upon any changes in these terms and conditions, Techwave will update the terms and conditions on its website www.store.techwave.com.au.
